49 CFR §382.307 requires reasonable suspicion testing when a trained supervisor observes behavior, appearance, speech, or body odors consistent with drug or alcohol use. Testing must occur as soon as practicable. Alcohol testing must be conducted within 8 hours of the observation, or documentation must explain why testing was not performed. Drug testing should occur as soon as possible but must be within 32 hours.
Reasonable suspicion is based on specific, observable signs such as behavior (aggression, withdrawal), appearance (bloodshot eyes, unsteady gait), speech (slurred words), or body odors consistent with substance use. The observation must be made by a supervisor trained in detecting these signs.
Yes. 49 CFR §382.603 requires supervisors to complete at least 60 minutes of training on alcohol misuse signs and 60 minutes on controlled substance use signs before they can make reasonable suspicion determinations. DSC provides this required training.
