DataQs Challenges
When an inspection, violation or crash on your record is wrong, a DataQs request asks the agency that reported it to review it. We gather the evidence, write the request and file it in FMCSA's DataQs system for you. $70 per company.
DataQs is FMCSA's online system for asking a state or federal agency to review inspection, violation and crash data it reported about your company or driver. The agency that issued the record decides, so the request needs a clear explanation and the documents that prove it.
A roadside inspection can follow your company for years. Violations and crashes feed FMCSA's Safety Measurement System (SMS), which shippers, brokers and insurers check, and inspectors use the same data to decide which trucks to pull in. When a record is wrong, waiting doesn't fix it.
What DataQs is for
DataQs is the online system FMCSA uses for requests to review data reported about a carrier or driver. Common reasons to file:
- A violation was written up, then the citation was dismissed or reduced in court
- An inspection or crash was assigned to the wrong carrier or the wrong USDOT number
- A violation was recorded incorrectly, or the same violation appears twice
- A crash type that may qualify for FMCSA's Crash Preventability Determination Program
- A driver or vehicle detail on the report doesn't match your records
How we handle it
Our carrier compliance team reviews your inspection reports and SMS record with you, decides which items are worth challenging, and tells you which documents will support each one. Then we write a clear, factual request, attach the evidence and file it in DataQs. We track the request and let you know when the agency responds.
We file the request; the state or federal agency that reported the data decides it. We'll tell you plainly when an item isn't worth challenging.
Keep it from happening again
Many violations trace back to records: an expired medical card, a missed annual review, a driver missing from the random pool. Our driver file management, Clearinghouse services and DOT drug testing consortium keep those records current. If a pattern is showing up on your record, a compliance consultation finds the cause.

Compliance Requirement
What can be challenged
DataQs accepts requests to review crash, inspection and violation data that state and federal agencies report to FMCSA. Each request goes to the agency that reported the data, usually the state where the inspection or crash happened, and that agency decides whether to change it.
Who can file
The motor carrier, the driver, or someone filing on their behalf. Each request needs an explanation and supporting documents.
Supporting documents that help
- Court records showing a citation was dismissed, reduced or found not guilty
- The inspection report and the records that contradict it, such as ELD logs, repair receipts or the driver's medical certificate
- For crash preventability requests, the police accident report and any photos or video
How long the data counts
SMS uses inspection and crash data from the past 24 months. Pre-Employment Screening Program reports show 5 years of crashes and 3 years of inspections, so a corrected record matters well beyond the next few months.

Frequently Asked Questions
A request filed in FMCSA's DataQs system asking the agency that reported an inspection, violation or crash to review it. If the agency agrees the data is wrong, it corrects or removes it, and your SMS record updates.
No. The state or federal agency that reported the data decides every request. What we do is file a clear request with the documents that support it, and tell you up front when an item isn't worth challenging.
Not always. The court outcome doesn't automatically update the inspection record, so a DataQs request with the court documents is usually how it gets reviewed.
The inspection or crash report, plus whatever shows the record is wrong: court records, ELD logs, repair receipts, a medical certificate, or the police report and photos for a crash. We'll tell you what to send for each item.
$70 per company to prepare and file. If you'd like a broader review of your safety record, compliance consultation is $150 an hour.
Crashes can be reviewed through DataQs, and some crash types may qualify for FMCSA's Crash Preventability Determination Program. We'll check whether your crash fits an eligible type and what documents FMCSA will want to see.
